Statement of Rights You have the right to be represented by counsel. If you cannot afford an attorney one will be appointed to you upon request. If you are indigent, and if there is a substantial probability that you would be sentenced to jail as a result of being convicted. You have the right to a speedy trial. You have the right to a JURY TRIAL upon proper written request to the court. You have the right to have an information filed in writing stating the charges against you. You have the right to confront and cross examine in open court the witnesses which the prosecution calls to testify against you. You have the right to remain silent at trial and not be compelled by the court to testify if you choose to remain silent. You have the right to have a witness subpoenaed to ensure that anyone you desire to have in court will appear. You are considered innocent of any charges by this court. The burden of proving you guilty beyond a reasonable doubt is upon the City, or County or State. You have the right to voluntarily testify in your own defense, after which you can be cross examined by the prosecution. You have the right to appeal the verdict or judgement of this court to the District Court of jurisdiction and have a new trial upon proper request of this court. You have the right to be admitted to bail in accordance with the provision of the law.

IF YOU ENTER A PLEA OF GUILTY TO THE CHARGES AGAINST YOU, YOU WILL GIVE UP ALL OF THE RIGHTS SET FORTH ABOVE LEAVING YOURSELF AT THE MERCY OF THE COURT, AND YOU WILL BE SUBJECT TO SENTENCING. I know I have the right to be represented by an attorney but I do not wish to have one. My plea is knowingly and voluntarily made. There has been no force or coercion for me to make the plea. I understand the possible consequences of making a plea of guilty to the court. I am free from drugs/alcohol or anything that would impair my ability to make a decision. I know the minimum and maximum sentence that may be imposed for each charge including the possibility of consecutive sentence. I understand I may make a motion to withdraw my guilty plea at any time prior to sentencing. I understand I have twenty-eight (28) days after sentencing to appeal the judgement and sentence or any part thereof. I understand that Driving under the Influence of Alcohol and/or Drugs, Domestic Violence and Possession of a controlled Substance, Marijuana are enhanceable offenses and a subsequent conviction may result in increased fines, penalties, and /or jail. If you plead “guilty” of “no contest” to a charge in this case and you are not legally in the United States, you could be deported from the United States by the proper federal authorities. Deportation in not determined in State Court, but is determined by federal authorities. I understand that if I fail to notify the court at any time I become incarcerated within 30 days of incarceration the court shall waive the automatic payment stay and allow fines and/or restitution to go to collections when they become 90 days past due.
